Pricing and Payment
- Payment Terms:
- Customers agree to pay the listed prices for services and products at the time of booking or purchase.
- All payments must be made through the approved payment methods available on the Platform.
- All payments made via Organexia are primarily intended for the service providers, with the exception of Organexia’s commission.
- Transactions are carried out in Moroccan dirham. Prices displayed on the platform can be expressed in any currency. However, it is the DH displayed on the payment pages that constitutes the currency of the electronic transaction. Customers using a foreign card are debited with the currency of their account for the equivalent amount in dirham, according to the exchange rate on the day of settlement.
- Store Credit:
- Store credit can be purchased or received as a gift and used for future purchases on the Platform.
- Store credit is non-refundable and must be used within the validity period specified.
9. Withdrawal Clause
In accordance with Article 42 of Law No. 31-08 related to consumer protection, the right of withdrawal does not apply to services offered by our platform that are reserved for a fixed date and whose execution begins immediately after the reservation is confirmed.
This exclusion is justified by two main reasons:
- Engagement of Resources:
Once the reservation is confirmed, the service provider begins to mobilize the necessary resources for the service (reserving rooms, preparing equipment, engaging staff, etc.). These preparations incur obligations and costs for the service provider, making any cancellation financially burdensome.
- Inflexibility of Fixed Dates:
Events with fixed dates cannot be rescheduled or canceled without causing significant disruptions. This rigidity explains why the right of withdrawal cannot apply to these services.
By accepting our general terms of sale, the consumer acknowledges and accepts that these services are not subject to the right of withdrawal.
10- Limitation of Liability
- Platform Access and User Responsibility: The Platform is accessible via the internet. Users are responsible for the installation and maintenance of their terminal and internet connection. Users acknowledge and agree that any notifications under these General Conditions may be sent to them via the contact email address provided during the creation of their profile on the Site. Users are responsible for any direct or indirect damage they may suffer due to inaccurate, incomplete, and/or misleading information provided during their registration or due to the lack of updates to this information, and they assume all consequences of such.
- Service Provider Obligations and Independence: Service Providers act independently and are not subordinated to Organexia SARL AU. The services provided by Service Providers are under their sole responsibility, adhering to their ethical guidelines, for which they are solely accountable. Service Providers acknowledge that they retain full responsibility for their legal and tax obligations concerning invoicing. Organexia SARL AU cannot be considered as an employer or agent of a User. Therefore, there is no subordination relationship, particularly of an employer/employee or agent nature, between the Company and a User.
- Independent Opinions: All opinions, advice, or responses provided by Service Providers are personal and do not reflect the positions of their affiliated organizations. The information displayed in a Service Provider’s profile is indicative, similar to a resume. The responsibility for the veracity or legitimacy of the information rests solely with the Service Providers. The advice and opinions given are strictly personal and delivered independently. Organexia SARL AU cannot be held responsible for any non-compliance with ethical or professional rules by the Service Providers, nor for any fraud, tort, or offense committed by the Service Providers, Users, or any third party during the use of the Platform.
- User Requests and Additional Costs: Customers are solely responsible for their requests to the Service Provider. In case of an error in the description of the request, Customers will bear any additional necessary services and related costs. Organexia SARL AU strives to ensure the accuracy and completeness of the information and documents provided by the Service Providers on the Platform. However, the Company cannot be held responsible for any violations of the obligations incumbent upon them, particularly in the fight against undeclared work and compliance with transparency rules, as well as any resulting damages.
- False Information and Content Responsibility: Organexia SARL AU strives to ensure that only the best Service Providers are featured on the Platform and that they deliver high-quality services. However, Organexia SARL AU does not guarantee the legitimacy of User requests or the content, quality, completeness, accuracy, or legal compliance of the services provided by the Service Providers. The responsibility for the veracity or legitimacy of the information rests solely with the Service Providers.
- Platform Availability and Obligation of Means: Organexia SARL AU makes every effort to ensure access and proper functioning of the Platform and Services 24/7. Organexia is committed to implementing the necessary means to provide the Service within the framework of an obligation of means only, and not within the framework of an obligation of results. No warranty is provided by the Company, other than the conformity of the Platform to these General Conditions. Organexia SARL AU is not liable for any direct or indirect damages arising from the use of the Platform or services. In case of a data breach, users will be contacted by email with details of the breach and steps being taken to address it. Organexia will take immediate action to mitigate the breach and support affected users, including providing information on how to protect their data.
Force Majeure
- The responsibility of Organexia cannot be implemented if the non-performance or delay in the performance of any of its obligations described in these GTC results from a force majeure event.
- Organexia is only liable for the performance of its obligations insofar as they are not impeded by an event of force majeure.
- Force majeure in contractual matters occurs when an event beyond the control of the debtor, which could not have been reasonably foreseen at the conclusion of the contract and whose effects cannot be avoided by appropriate measures, prevents the performance of their obligation by the debtor. If the impediment is temporary, the execution of the obligation is suspended unless the resulting delay justifies the termination of the contract. If the impediment is permanent, the contract is terminated by law and the parties are released from their obligations under the conditions provided by the Civil Code.
- In this respect, the responsibility of Organexia cannot be engaged, in particular, in the event of a hacker attack, unavailability of materials, supplies, spare parts, personal or other equipment; and interruption, suspension, reduction, or disturbances in electricity or other utilities or any interruptions of electronic communication networks, as well as the occurrence of any circumstance or event outside the control of Organexia occurring after the conclusion of the GTC and preventing execution under normal conditions.
- It is specified that, in such a situation, the User cannot claim any compensation and cannot take any action against Organexia.
- In the event of the occurrence of one of the above-mentioned events, Organexia will endeavor to inform the User as soon as possible.
11. Indemnification
- Users agree to indemnify and hold harmless the Company, its directors, officers, employees, and agents from any and all losses, expenses, damages, and costs, including attorney fees, resulting from any violation of the general terms and conditions of use of the Organexia platform.
- Users agree to indemnify Organexia/the Company, its directors, officers, employees, and agents against any wrongful or negligent behavior on the part of the users.
- Service providers agree to indemnify Organexia for any claims or costs arising from their failure to comply with their tax obligations.
12. Dispute Resolution and Jurisdiction
We encourage our customers and service providers to resolve conflicts amicably. If an agreement cannot be reached, users are advised to contact Organexia’s customer service for assistance.
These General Terms and Conditions of Use and Sale (GTCUS) are governed by Moroccan law. Any disputes arising from the use of the Platform or services, or relating to the formation, conclusion, interpretation, and/or execution of these GTCUS, will be resolved through amicable negotiation.
If a resolution cannot be reached through negotiation, the disputes will be definitively and exclusively settled in accordance with the regulations of the International Court of Mediation and Arbitration IRCMAR in Rabat by an arbitrator appointed in accordance with these regulations.
If neither amicable negotiation nor arbitration resolves the dispute, the matter will be referred to the competent courts within the jurisdiction of the Tribunal of Tangier, where the company’s headquarters are located. The reference language for the settlement of potential disputes is French or Arabic.
13- Non-bypassing

18. Nullity and Waiver
- If any clause of this contract is declared null and void due to a change in legislation, regulation, or a court decision, this shall not affect the validity and compliance with these General Conditions.
